Welcome to Dr. Clarke’s Parkinson’s Protocol, an educational online course provided by Neuroscience Explained (“we,” “us,” or “our”). By enrolling, you enter into a legally binding agreement with us. These Terms and Conditions (“Terms”) govern your use of the Program, including all websites, videos, downloadable resources, and subscription services (collectively, the “Program”). Please read these Terms carefully before proceeding.
NOTICE OF ARBITRATION AND CLASS ACTION WAIVER**: THESE TERMS INCLUDE A MANDATORY ARBITRATION PROVISION (SECTION 11) AND A CLASS ACTION WAIVER (SECTION 12) THAT LIMIT YOUR RIGHTS TO A COURT HEARING OR JURY TRIAL. PLEASE REVIEW THESE SECTIONS CAREFULLY.
1. Your Agreement to These Terms
By enrolling in the Program or accessing any content, you agree to be bound by these Terms, any additional terms for specific features (“Additional Terms”), and all applicable laws. These Terms apply whether you are a guest or registered user. Program policies communicated through the platform (“Program Policies”) are also part of this agreement. If you do not agree, you may not use the Program.
2. Program Overview and Purpose
Dr. Clarke’s Parkinson’s Protocol provides strategies, tools, and information to help manage Parkinson’s symptoms and improve daily function through science-backed, educational methods. It is not a medical treatment, cure, or substitute for professional healthcare advice. Always consult your healthcare provider before starting or making health-related changes.
3. Who Can Use the Program
The Program is intended for adults in regions where offered. You may not use the Program if you are:
– Under 18 years old (or under 13, as we do not knowingly collect data from children under 13). Users aged 13–18 may participate with parental or guardian consent.
– Not of legal age to form a binding contract with us.
– Barred from using the Program under your jurisdiction’s laws.
By using the Program, you confirm you meet these eligibility requirements. We may terminate access for non-compliance.
4. Account Setup and Responsibilities
– **Registration**: To use the Program, you must create an account with accurate, complete, and current information. You are responsible for updating this information to keep it accurate.
– **Security**: You must keep your username, password, and account details confidential. You are fully responsible for all activities under your account, including unauthorized use. Notify us immediately at support@[domain].com of any security breach.
– **Termination for Misuse**: We may limit, suspend, or terminate your account if you provide inaccurate information or if we suspect unauthorized use.
5. Payment, Subscriptions, and Cancellations
– **Enrollment Fee**: The Program costs $600 for 6 months of full access, payable upfront upon enrollment.
– **Subscription**: After 6 months, continued access to the entire Program, including core content, updates, the latest scientific insights, and exclusive Dr. Clarke videos, is available for $50/month. This subscription auto-renews monthly until canceled (see below).
– **Payment Processing**: Payments are processed securely via a third-party processor. We do not store payment information. You authorize us to charge your payment method for the initial fee and recurring subscriptions.
– **Auto-Renewal**: Subscriptions renew monthly for 1-month periods. You will be charged no more than 24 hours before each renewal. If payment fails (e.g., expired card), you remain responsible for uncollected amounts, and we may attempt to charge an updated method. We may cancel your subscription if payment fails repeatedly.
-**Price Changes**: Your subscription price ($50/month) will remain unchanged for as long as you maintain continuous enrollment without cancellation. We may adjust subscription prices for new or returning subscribers with reasonable notice (e.g., email, Program notification). If you cancel your subscription and later re-enroll, you will be subject to the current market rate at the time of re-enrollment (e.g., if the rate increases to $75/month, you will pay $75/month upon re-enrollment).
– **Cancellation**: You may cancel your subscription after the initial 6-month period by emailing info@neuroscienceexplained.com at least 5 business days before the next billing cycle. Upon cancellation, all access to the Program, including core content, updates, scientific insights, and exclusive videos, will terminate at the end of the current billing cycle. You will not retain access to any Program content after cancellation unless you re-enroll.
6. Refunds and Access Policies
– **Refund Policy**:
– **Initial Fee**: Refunds for the $600 fee may be requested within 14 days of purchase via info@neuroscienceexplained.com, subject line “Refund Request.” Requests are subject to review, and approved refunds process within 10 business days to the original payment method.
– **Subscription Fees**: Fees after the initial 6 months are non-refundable, except as required by law.
– **Other Fees**: Additional fees (e.g., optional materials) are non-refundable unless stated otherwise.
– **Access Duration**: The $600 fee grants 6 months of core content access. Subscription fees provide ongoing access to the entire Program as described in Section 5.
7. Intellectual Property and Usage Rights
– **Ownership**: All Program content (videos, text, resources, graphics, trademarks, software) is owned by or licensed to Neuroscience Explained, protected by copyright, trademark, and other intellectual property laws.
– **License**: We grant you a limited, personal, non-transferable, non-sublicensable, non-exclusive, terminable license to access and use the Program for personal, non-commercial purposes. No third-party license is granted.
– **Restrictions**: You may not copy, reproduce, distribute, modify, or create derivative works of Program content without written consent.
– **Feedback**: Feedback you provide is non-confidential, and we may use it without restriction or compensation.
8. User Responsibilities and Conduct
– **Compliance**: You agree to use the Program responsibly, complying with applicable laws and these Terms.
– **Prohibited Actions**: You may not:
– Use the Program for unlawful purposes.
– Impersonate others or misrepresent affiliations.
– Obtain unauthorized materials.
– Resell or publish Program content.
– Upload offensive or defamatory content.
– Interfere with security features (e.g., using bots, scraping tools).
– Disrupt the Program or others’ use.
– **Account Activity**: You are responsible for all activity under your account and must report unauthorized use.
9. Disclaimers, Risks, and Limitations
– **Educational Purpose**: The Program is for educational, informational, and research purposes only. It is not intended to diagnose, treat, cure, or prevent any disease, nor replace professional medical advice. Consult your healthcare provider before starting or making health changes. No doctor-patient relationship is established.
– **Scientific Information**: The Program may discuss scientific studies or the structure/function of compounds (e.g., “A 2020 study in *Journal of Neurology* found omega-3s in fish oil may support a healthy inflammatory response, reducing inflammation by 25% in participants”). These discussions are for general educational purposes only, do not apply to specific conditions like Parkinson’s unless advised by your doctor, and are not intended as health claims or endorsements of specific products. Results from studies vary and are not guaranteed for all individuals. This statement has not been evaluated by the FDA. This product is not intended to diagnose, treat, cure, or prevent any disease. Consult your doctor before applying this information.
– **Risks**: Program strategies are based on current research but may not apply to you. Information may provoke emotional responses or reveal unexpected insights. Sharing Program information (e.g., with family, employers) may have consequences, such as inclusion in medical records or misuse. Future research may alter interpretations. You rely on the Program at your own risk.
– **No Warranties**: The Program is provided “as is” without warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted, error-free access, accuracy, or that the Program will meet your needs. Access may be interrupted for maintenance, updates, or unforeseen issues.
– **Limitation of Liability**: To the fullest extent permitted by law, Neuroscience Explained, its affiliates, and their officers, directors, employees, agents, successors, and assigns are not liable for indirect, incidental, special, consequential, or exemplary damages (e.g., loss of profits, data, goodwill), even if advised of the possibility, arising from:
– Use or inability to use the Program.
– Actions based on Program information.
– Unauthorized account access.
– Third-party conduct or content.
– Errors, interruptions, or discontinuation.
Your sole remedy for dissatisfaction is to stop using the Program. Some jurisdictions may not allow these limitations.
10. Dispute Resolution: Arbitration
Any dispute related to these Terms or the Program shall be resolved through confidential arbitration in Houston, TX, unless we seek injunctive relief for intellectual property violations in state or federal courts in Houston, TX, where you consent to jurisdiction and venue. Arbitration follows the American Arbitration Association’s Commercial Arbitration Rules with a single arbitrator experienced in the dispute’s subject matter. The arbitrator’s fees are borne by the prevailing party or allocated as deemed appropriate by the arbitrator. Each party bears its own legal costs. Arbitration must conclude within 120 days of notice or filing. The arbitrator’s award is binding and enforceable in court. All proceedings and documents are confidential unless required by law.
11. Class Action Waiver
To the fullest extent permitted by law, disputes must be resolved on an individual basis. You agree not to join or consolidate claims with others, participate in class actions, or act in a private attorney general capacity. The arbitral tribunal may not preside over class proceedings or consolidate claims. Challenges to this waiver must be raised in a court of competent jurisdiction.
12. Indemnification
You agree to indemnify, defend, and hold harmless Neuroscience Explained, its affiliates, and their officers, directors, employees, agents, successors, and assigns from any claims, losses, damages, or expenses (including reasonable attorneys’ fees) arising from:
– Your violation of these Terms, Additional Terms, or Program Policies.
– Your use of the Program.
– Violation of another’s rights or applicable laws.
– Sharing of Program information.
This obligation survives termination of your use.
13. Third-Party Services
The Program may include educational discussions about compounds like fish oil, supported by scientific studies, in its materials. These discussions are for informational purposes only and do not endorse specific products. Separately, the User Portal includes a Recommended Products section with links to third-party products or services that may support your journey. These are subject to the third parties’ terms and conditions, and we are not responsible for any loss or damage resulting from your interactions with them. 14. Affiliate Relationships
In the User Portal’s Recommended Products section, we list products or services Dr. Clarke recommends, including links to purchase them. Some products, like Neupanex, are owned by Dr. Clarke, and we earn revenue from their sales. For other products, we may receive commissions or other compensation for purchases made through these links, which helps support the Program. Such compensation does not influence the educational content of the Program but may influence the products or services we choose to recommend. We disclose this relationship near each link (e.g., “Neupanex is owned by Dr. Clarke” or “We may earn a commission if you purchase through this link”). 15. Electronic Communications
You consent to receive communications electronically (e.g., email, Program notifications). All notices and disclosures provided electronically satisfy legal requirements for written communication. Keep your email updated to receive these.
16. Governing Law and Timing of Claims
– **Governing Law**: These Terms are governed by the laws of Texas, without regard to conflict of law provisions. Non-arbitrated disputes will be resolved in Houston, TX courts, where you consent to jurisdiction.
– **Timing**: Claims must be filed within 1 year of accrual, or they are barred, regardless of any statute to the contrary.
17. General Provisions
– **Headings**: Section headings are for reference and do not affect interpretation.
– **Severability**: If a provision is invalid, it will be amended to achieve its intent, and other provisions remain in effect.
– **Assignment**: You may not assign your rights without our consent. We may assign ours without notice.
– **No Third-Party Beneficiaries**: These Terms do not confer benefits on third parties.
– **Entire Agreement**: These Terms, including the Privacy Statement and Program Policies, are the entire agreement, superseding prior agreements.
– **Waiver**: Our failure to enforce a right does not waive it.
– **Survival**: Provisions intended to survive termination (e.g., indemnification, liability limits) remain in effect.
